+ CO.PET. 285/2015 LALIT PIPES & PIPES LTD.

..... Petitioner Through Mr.Arvind Kumar and Mr.C.S.Chauhan, Advs.

versus NTPC BHEL POWER PROJECTS PVT. LTD...... Respondent Through Mr.A.K.Roy, Adv.

CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 17.07.2018 It is admitted fact in this case that the respondent company has paid the entire principal amount amounting Rs.4,82,69,083/-. The issue of delay in making payment remains. Learned counsel for the respondent states that as a goodwill gesture they will pay another sum of Rs.3 lacs within four weeks from today.

Learned counsel for the petitioner very fairly accepts the offer made. Payment shall be made within four weeks from today. Petition is accordingly disposed of as infructuous. In case there is default on the part of the respondent to make the said balance payment liberty is granted to the petitioner to seek revival of the winding up petition. In that eventuality petitioner would be entitled to make the full claim for interest, as per law. Dasti.
