Aggrieved by the communication dated 29th August, 2016 rejecting the application of the petitioner for grant of parole on the ground that he has to file the Special Leave Petition, the petitioner has preferred the present petition seeking parole.

On a notice being issued, a status report has been filed. Though the allegations against the petitioner are of committing rape of his daughter aged 8 years, as per the verification report the victim along with her mother is residing at the house of her maternal grandparents at Farukhabad, U.P. whereas the father of the petitioner is residing at Shastri Park, Nathupura, Burari, Delhi.

On verification it has been found that if released on parole the petitioner would be staying at Nathupura, Burari, Delhi, along with his father.

Considering the fact that the petitioner has to file the Special Leave Petition and he has been in custody for more than four years including remissions, I deem it fit to grant parole to the petitioner for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹15,000/- with two sureties of the like amount, out of which one surety would be of the family member of the petitioner, subject to the satisfaction of the learned Trial Court/CMM/Duty Magistrate. During the period of parole, the petitioner will not leave the National Capital Region of India.
