Transfer is sought of an appeal bearing No.21/2016 titled as Harjit Singh Vs. Manmohan Singh of the Court of Sh. Sanatan Prasad, Additional District Judge, Tis Hazari Courts, Delhi stated to be listed next on 11th January, 2018 to the Court of Ms. Neelofer Abida Parveen, Additional District Judge, Saket Courts, New Delhi where appeal No.16/2016 titled Manmohan Singh Vs. Harjit Singh and stated to be listed next on 28th October, 2017 is pending.

None appears for the respondent despite service and despite the counsel for the respondent having appeared on earlier two dates. 3.

Need to await the respondent, considering the nature of the petition, is not felt.

The counsel for the petitioner has argued that the appeals arise from two suits filed by the petitioner, one of which has been decided in favour of the petitioner and the other against the petitioner and that the property in both the appeals is the same.

The petition is allowed.

Appeal No.21/2016 of the Court of Sh. Sanatan Prasad, Additional District Judge, Tis Hazari Courts, Delhi is ordered to be transferred to the Court of Ms. Neelofer Abida Parveen, Additional District Judge, Saket Courts, New Delhi where appeal No.16/2016 is pending. 7.

The parties to appear before the transferee Court on 28th October, 2017.

The Additional District Judge/District Judge, Tis Hazari Courts, Delhi to ensure that the file is physically transferred before that date. No costs.
