% 22.01.2019 Notice. Respondent nos.2 and 3, namely, Mr. Kadir Khan and Mr. Joginder Tanwar @ Gajju are present in Court and accept notice. They have been identified by SI Kamal Singh of police station Sangam Vihar. Respondent nos.2 and 3 submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion, vide a Compromise Deed dated 17th May, 2018. Petitioners have jointly paid `15,000/- to each of respondent nos. 2 and 3 towards compensation. Respondent nos. 2 and 3 say that they have no objection in
case FIR No. 311/2012 under Sections 323/341/34 IPC registered at Police Station Sangam Vihar and consequent proceedings emanating therefrom are quashed.
Affidavits of respondent nos. 2 and 3 to this effect are also on record.
Keeping in mind the settlement arrived at between the petitioners and private respondents voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
