% 25.01.2018 As per office report, respondent no.2 has remained unserved. However, she has appeared in court and has been identified by SI N K Singh of police station Sarojini Nagar.
Petitioner no.1 is sister-in-law (jethani) and petitioner no.2 is mother-in-law of respondent no.2 while husband of respondent no.2 has already expired on 27th March, 2009. Respondent no.2 submits that she has settled the matter with petitioners out of her own free will, without any undue force, pressure or coercion. She further submits that she has no objection if FIR 386/2003 under sections 498A/406/506/34 IPC registered at police station Sarojini Nagar, is quashed against the petitioners in view of the settlement. Affidavit of respondent no.2 is also on record as annexure P-6.
Keeping in mind the settlement arrived at between the concerned parties voluntarily, in the interest of justice, FIR 386/2003 under sections 498-A/406/506/34 IPC registered at police station Sarojini Nagar and the consequent proceedings emanating therefrom are quashed.
