CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 18.05.2015 Crl. M.A. No.7462/2015 (exemption) Allowed, subject to all just exceptions.
Application is disposed of.
W.P.(CRL) 1050/2015 Petitioner no. 1 is sister-in-law (bhabi) of respondent no. 2. Petitioner no. 2 is niece of respondent no. 2. Respondent no. 3 is father of respondent no. 2 and father-in-law of petitioner no. 1. FIR no. 377/2015 under Sections 323/427/452/34 IPC was registered at Police Station Jahangir Puri on the
complaint of respondent no. 2. He alleged in the FIR that petitioners racked up a quarrel with respondent no. 2 and gave danda blow to him. Investigations are at preliminary stage. Being members of the same family, petitioners and respondent nos. 2 and 3 have resolved their disputes amicably in order to maintain harmonious relationship in future. They are living in the same house at different floors. Respondent nos. 2 and 3 are present in Court and state that they have no objection in case FIR in question is quashed.
Keeping in mind that a quarrel took place between the parties on a trivial matter and they have now resolved their differences, inasmuch as want to maintain harmonious relation in future in order to maintain peace and harmony in the family, no fruitful purpose would be served in keeping the criminal proceedings pending.
Accordingly, in the interest of justice, FIR no. 377/2015 under Sections 323/427/452/34 IPC was registered at Police Station Jahangir Puri and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
