% 13.11.2017 None appears for the petitioners, though the matter has been called twice over. Petition has come to be filed alleging unauthorized construction with the prayers as follows:- "a) issue the writ/order/direction in the nature of writ of mandamus directing the respondent No.1 to take legal action to demolish the illegal and unauthorized construction raised by the respondent No.3 over the suit property No. 826-K-2, Kedar Building, Subzi Mandi, Delhi-110007.

b) Issue the writ /order/direction in the nature of writ of prohibition restraining the respondent No.1 and 2 from permitting the respondent No. 3 for making any further illegal and unauthorized construction over the suit property and further from putting the illegal and unauthorized construction into use by the respondent No.3 or any other person in any manner whatsoever."

It is the bounden duty of the respondent No.1 to take requisite and immediate steps for any unauthorized constructions getting raised.

Respondent No.1, on his part, failed to even file the status report within the time permitted by the Court. Commissioner, North Delhi Municipal Corporation and DCP Central are, therefore directed to ensure that no unauthorized construction comes to be raised and take immediate requisite steps for stopping any unauthorized construction, and/or demolition thereof, immediately and not beyond two weeks from today.
