O R D E R

% 06.03.2017 Learned counsel appearing on behalf of the petitioner submits that they have received a sum of Rs.25,73,000/- from the respondent company till date.

Learned counsel appearing on behalf of the respondent company has handed over a cheque drawn on Axis Bank, Green Park, New Delhi, bearing No.849774 dated 4.3.2017 in the sum of Rs.1,26,062/- in favour of petitioner company in court today. Learned counsel appearing on behalf of the petitioner acknowledges the receipt of the same, subject to encashment.

In view of the foregoing, it is an admitted position that the entire amount admitted as being due towards the petitioner, in terms of the order dated 7.10.2016, has been discharged.

Learned counsel appearing on behalf of the respondent company further undertakes to pay 9 per cent interest on the delayed payments to the petitioner company within a period of six months from today. The rate of interest will reckon from the date the payments were due till the date the payments are made. The said undertaking is hereby accepted.

In view of the foregoing, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to approach this court in the event the respondent company defaults on the undertaking as recorded above.

Leave and liberty granted.

The petition is dismissed as withdrawn and disposed of accordingly.
