O R D E R

% 20.09.2017 Learned counsel for the petitioner submits that petitioner and complainant have settled their disputes amicably and have decided to live separately, inasmuch as, the first motion of divorce by mutual consent, has already been accepted by the Family Court.

Learned counsel for the petitioner further submits that the petitioner would soon file a petition for quashing of the FIR.

Respondent no. 2 is present in Court along with her counsel and admits the factum of settlement of disputes with petitioner and also that the first motion of divorce has been accepted by the Court. Interim protection was granted to the petitioner vide order dated 19th September, 2016, which is still continuing.

Keeping in view the settlement arrived at between the petitioner and

respondent no. 2 and also considering the fact that first motion has already been accepted, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `20,000/-(Rupees Twenty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.

However, the petitioner shall co-operate in the investigation and shall appear before the Investigating Officer as and when he is called upon to do so. Bail application is disposed of in the above terms. Dasti.
