% 23.09.2016 CM No. 35042/2016 (exemption) Exemption is allowed subject to all just exceptions. CM(M) 955/2016 and CM No. 35043/2016 (stay) The limited prayer made in the present petition is that the petitioner instituted a suit on 02.07.2015 for declaration and permanent and mandatory injunction against the respondents. Along with the suit an application for ad interim injunction has also been filed. It is urged that despite several hearings, the trial court has not heard and disposed of the application for interim injunction which is causing irreparable loss and injury to petitioner. A perusal of the record/trial court order sheets shows that the application under Order 39 Rules 1 & 2 CPC is part heard along with an CM(M) 955/2016

application under Order 7 Rule 11 CPC. On 30.03.2016 and 01.06.2016, the counsel for the one defendant or the other requested for the adjournment and the matter was adjourned.

In view of the above, the trial court is requested to expeditiously dispose of the injunction application as per law and no adjournment should be given to either of the parties while considering the said application. The petition stands disposed of.
