Y W.P.(CRL) Nos. 2695/2016 and 2818/2016 By these writ petitions, petitioners have prayed for quashing of following FIRs:- (a) FIR No. 318/2016 under Sections 354(A)/323/34 IPC registered at P.S. Sagar Pur on the complaint of Ms. Shashi (respondent no. 2 in W.P.(Crl.) No. 2695/2016 and petitioner no. 3 in W.P.(Crl.) No. 2818/2016). (b) FIR No. 319/2016 under Sections 323/34 1 IPC registered at P.S. Sagar Pur on the complaint of Mr. Mohit Gin (respondent no. 2 in W.P.(Crl.) No. 2818/2016 and petitioner no. 3 in W.P.(Crl.) No. 2695/2016). Petitioner no. 1 Rakesh Giri in W.P.(Crl.) No. 2695/2016 is uncle of respondent no. 2 Mohit Giri in W.P.(Crl.) No. 2818/2016. Other petitioners are either relatives of Rakesh Giri/Mohit Giri or are their neighbourers.
It 11 appears that a quarrel took place between both the groups, resulting in registration of above referred cross FIRs. Complainant party as well as accused panty in both the cases have now settled their disputes, vide two separate agreements dated 41h July, 2016. Complainants in the FIRs, that is, Mr. Mohit Giri and Ms. Shashi are present in Court and state that they have no objection in case FIRs are quashed in view of the settlement arrived at between the panties.
Keeping in mind that accused and complainants in the above FIRs are neighbours and a quarrel took place between them on some trivial issue, which resulted in filing of cross FIRs and now they have settled their disputes amicably and do not wish to pursue the FIRs, in the interest of justice both the FIRs, that is, FIR No. 318/2016 under Sections 354(A)/323/34 IPC and FIR No. 319/2016 under Sections 323/341 IPC, both registered at P.S. Sagar Pur, which are at investigation stage, are quashed. Both the writ petitions are disposed of in the above terms. Dasti. JC-'~ A.K. ATHAK, J.
