% 26.07.2017 By the petition, the petitioner seeks directions to energise a fresh electricity connection of 2 KW (NX) in the godown on the ground floor of the premises bearing no. 3512 (GF), Street No. 6, Rahgarpura, Karol Bagh, New Delhi-110055.
Pertinently, the instant petition is the outcome of the disputes amongst the tenant-the petitioner and the landlord-the respondent no.2 in respect of the tenancy premises.
It is not in dispute that the premises in question is subject to the provisions of Delhi Rent Control Act.
During the course of hearing, on being queried, ld. counsel for the petitioner concedes that the amenity of electricity supply, which was provided to the petitioner at the time of letting out, was disconnected long time back and the petitioner has been using the subject premises with an inverter installed for the purpose. It is also
not in dispute that the respondent no.2 has filed an eviction petition before the Rent Controller and is now at the final stages. In the given facts and circumstances, at this stage, ld. counsel for the petitioner seeks to withdraw the petition with the liberty to approach the Rent Controller with an appropriate application seeking restoration of the electricity connection or such other relief(s) to which, petitioner may be entitled to.
Dismissed as withdrawn, as prayed.
