% 19.09.2016 Present writ petition has been filed challenging the letter dated 27th January, 2016 whereby the respondent has levied unearned increase on the petitioner amounting to Rs.13,83,706/-. Petitioner also seeks conversion of the plot from leasehold to freehold. Learned counsel for petitioner also states that the transfer in the present case falls within the ambit of family members as defined under the policy of DDA. He also draws this Court's attention to judgment dated 8th December, 2009 passed in LPA No.28/2004. He also states that despite the attention of DDA being drawn to the aforesaid judgment, no response has been received. Keeping in view of the aforesaid facts, present writ petition is disposed of with a direction to the petitioner to file a comprehensive representation within a period of one week. The said representation is directed to be disposed of by DDA by way of a speaking order within

a period of eight weeks after taking into consideration the aforesaid Division Bench judgment as well as other relevant judgments, if any. The reasoned order shall be communicated to the petitioner by Registered AD post.
