% 08.09.2017 It is submitted that petitioner and respondent nos.2 and 3 have settled their disputes amicably before the Delhi High Court Mediation and Conciliation Centre on 11th April, 2017, vide "Annexure C"; therefore, FIR No.105/2011 under Sections 409/420 IPC registered at police station Darya Ganj on the complaint of respondent no. 2, may be quashed. It is submitted that respondent no. 2 is the brother-in-law of respondent no. 3. Respondent no. 3, who is an Advocate, submits that he has been authorised by the respondent no. 2 to accept the balance payment from the petitioner on his

behalf. Petitioner has paid `4,75,000/- each vide two cheques favouring respondent nos. 2 and 3 respectively, which have been accepted by the respondent no. 3, subject to its realization. Photocopies of the cheques have been placed on record. Respondent no. 3 submits for himself and on behalf of the respondent no. 2 that he has no objection in case the present FIR is quashed, subject to realization of the cheques. Keeping in mind the settlement arrived at between the parties, in the interest of justice, FIR No.105/2011 under Sections 409/420 IPC registered at police station Darya Ganj and the consequent proceedings emanating therefrom are quashed, subject to encashment of the aforesaid cheques.
