% 28.09.2016 Learned counsel for the respondent at the outset submitted that the present order has been passed by the Court of Civil Judge under Order 39 Rules 1 & 2 CPC dismissing the said application and that the said order is an appealable order under Order 43(r) of CPC.

In view of the said submission of the respondent, learned counsel for the petitioner submits that he would like to withdraw the present petition with liberty to file an appeal before the appropriate court.
