The learned counsel for the petitioner states that the petitioner has already appointed Mr. Amit Singh as an arbitrator by its letter dated 17.11.2016. He further states that the Statement of Claims has also been filed and a preliminary hearing before the arbitrator is now scheduled on 24.01.2017.

A copy of the letter appointing the arbitrator has also been handed over to the learned counsel for the respondent. 2.

In the present circumstances, the petition is disposed of with directions that the interim orders passed on 19.09.2016 shall continue till further orders are passed by the arbitrator. The petitioner is at liberty to file an appropriate application under Section 17 before the Arbitrator including for the relief as prayed for in the present application. The respondent is also at the liberty to apply to the arbitrator for vacation/modification of the OMP (I) (COMM) 372/2016

interim order passed on 19.09.2016. It is clarified that in the event such an application is filed the same would be considered uninfluenced by any observations made by this Court in the order dated 19.09.2016. 3.

The petition is disposed of.
