W.P.(CRL) 2542/2018 Learned counsel for the respondent point out that since a show cause notice has been given under Section 124 read with Section 110 (2) of the Customs Act, the petitioner would be at liberty to reply to the same and take all the pleas before the adjudicating authority. Since proceedings have been initiated, writ petition is disposed of with liberty to the petitioner to take all the pleas before the competent authority in reply to the show cause notice.

Needless to note that the adjudicating authority would consider all the legal issues raised by the petitioner, including those in the present petition. W.P.(CRL) 2542/2018
