% 26.10.2016 CM No.40080/2016 (exemption) Allowed, subject to all just exceptions.
CM No.40079/2016 (delay) In the facts and circumstances explained in the application, delay in filing the appeal is condoned.
CM stands disposed of.
LPA No.592/2016 & CM No.40078/2016 (stay) 1.
The National Council for Teacher Education (NCTE) filed this appeal assailing the order of the learned Single Judge dated 23.05.2016 in W.P.(C) No.4667/2016.
2.
The said writ petition was filed by the respondent herein challenging the orders dated 06.11.2015 and 18.04.2016 passed by NCTE rejecting its
application for recognition for D.El.Ed. course for the Academic Session 2016-17 on the ground that the hard copy of the application was furnished after 15 days of submission of online application and that the same was in violation of Regulation 7(2)(b) of the NCTE Regulations, 2014. Though the learned Single Judge set aside the impugned orders and remanded the application of the writ petitioner to ERC of NCTE, it was directed that the application be processed for recognition for the Academic Year 2017-18. 3.
Having heard the learned counsel for both the parties, though we are not inclined to interfere with order under appeal since the direction was to process the application for the Academic Year 2017-18, we make it clear that the order under appeal shall not be treated as precedent. 4.
The appeal is accordingly disposed of.
A copy of order be given dasti under the signature of the Court Master.
