% 05.02.2016 Learned counsel for the petitioner submits that the present petition has been filed under Section 482 of the Code of Criminal Procedure against the order dated 6th April, 2015; for setting aside the order dated 10th April, 2010 passed by the learned Link Metropolitan Magistrate; for providing custody of the child; for remanding back the matter to learned Metropolitan Magistrate and to decide the application under Section 21 of Prevention of Women from Domestic Violence Act.
During the course of hearing, it was revealed that interim custody of the minor child was given vide order dated 6th April, 2015 to the effect that "seeking the exigency of the present matter, interim
custody of minor child is given to the petitioner till further orders." Apparently, it was an interim order.
Learned counsel for the petitioner seeks permission of this Court to withdraw the present petition and approach the Trial Court for his remedy.
Accordingly, the petition is dismissed as withdrawn with liberty as prayed for.
