CM(M) 973/2016 and CM No. 35551/2016 (stay) Learned counsel for the petitioner submits that by the impugned order dated 21.08.2016, the right of the petitioner to file the written statement was closed. He submits that the petitioner was served on 05.05.2016 but there was a delay in filing of the written statement as the suit is actually filed by an ex employee against the petitioner. The ex employee, it is stated, had deliberately made it difficult for the petitioner to identify the necessary documents required for the purpose of filing of the written statement. An advance copy of the petition has been sent to the respondent by speed post but none is present for him.

In the interest of justice, subject to payment of costs of RS.7,500/-, the
