% 31.10.2018 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition, the petitioner reserving the right to raise the contentions set out in the petition as defences before the Metropolitan Magistrate in the proceedings arising out of the petition of the second and third respondents under Protection of Women from Domestic Violence Act, 2005, the said case already having reached the stage of evidence of the petitioner, he being the respondent in such proceedings.

Needless to add, as is requested, given the old pendency of the matter, it is hoped and expected that the trial court will proceed with the matter and take it to the stage of adjudication at an early date. But for this, the parties CRL.M.C. 2130/2015

including the petitioner herein will also be expected to cooperate with the trial court.

The petition stands dismissed as withdrawn.
