CORAM:

HON'BLE MR. JUSTICE VIPIN SANGHI

O R D E R

% 21.09.2016 The petitioner has preferred the present petition to seek quashing of the order dated 11.08.2016 whereby the respondent/ State has rejected the petitioner's application seeking parole. The petitioner also seeks a direction for being released on parole for a period of three months to reconnect with the society. The nominal roll is on record. The same shows that the petitioner stands convicted under Section 363/364A read with 120B/34 IPC registered at PS Sultanpuri in case FIR No.83/2005. He has been sentenced to undergo rigorous imprisonment for life along with fine of Rs.14,000/-, and in default of payment of fine to undergo further sentence of one year and four months simple imprisonment. The appeal has been dismissed by this court on 20.07.2012.

The jail conduct of the petitioner has been found to be unsatisfactory. He has repeatedly been punished on several occasions from 2012 till as late as 07.06.2016. In 2016 itself, he has been punished twice on 11.05.2016 and 07.06.2016 for breaching discipline of the jail. One of the co-convict, who was released on parole has jumped the bail and is on the run since 10.06.2013. Looking to the jail conduct of the petitioner, he is not entitled to parole at this stage.

Dismissed.
