% 16.09.2016 This writ petition is directed against an order of transfer whereby the petitioner has been posted from 25th Batallion, BSF, Chawla Camp, New Delhi to the 127th Batallion, BSF deployed at Jammu. The petitioner seeks abeyance of the movement order for a period of six months only and no more, having regard to the fact that the petitioner and his wife are undergoing third cycle of IVF treatment at the Adam Eve Test Tube Centre and Research Institute, Noida.
The petitioner and his wife have undergone two cycles of treatment at Adam Eve Test Tube Centre and Research Institute, Noida, and are now W.P.(C) 8182/2016
going through the third cycle. Having regard to the special facts and circumstances of the case and as an exception, the movement/transfer order shall be kept in abeyance for a period of six months and no more. It is made clear that after six months, the petitioner will not resist any order of transfer. The writ petition and the application are disposed of accordingly. INDIRA BANERJEE, J V.
