% 20.02.2019 CM APPL No.69/2019 This application is for modification of the order dated 03.12.2018 whereby the petitioner was granted two years time to vacate the premises, provided Rs.20,000/- per month be paid as user/occupation charges.

The learned counsel for the petitioner submits the petitioner intends to vacate the premises on or before 28.02.2019 and the provision under Section 19 of the DRC Act shall be applicable upon the respondent after eviction of the premises. The learned counsel for the respondent says the possession be handed over to the attorney of the respondent. Let the vacant and peaceful possession of the premises be handed over to the attorney of the respondent on or before 28.02.2019.

Qua the unpaid user/occupation charges, the respondent shall have liberty to take appropriate remedy as per law. The application stands disposed of in terms of above. Order dasti.
