IA No.10977/2018 On 09.07.2018 the defendant was restrained from using the mark VICTOR 80 in respect of its product, but was granted time till 30.09.2018 to effect the changes and order of permanent injunction was to come into operation from 01.10.2018.

The learned counsel for the defendant / applicant seeks extension of such time till 31.03.2019 to clear all the stock under the mark VICTOR 80. Though the learned counsel for the plaintiff says they have no objection in case the defendant is given three months time to clear the stock, but the learned counsel for the defendant says the stock is seasonal and could be cleared only in the crop season from January to March 2019.

In these circumstances, the date of 30.09.2018 as is mentioned

in the order dated 09.07.2018 stands extended till 31.03.2019. It is also made clear that no further extension shall be given in any circumstances.
