O R D E R

% 26.09.2016 The petitioner has preferred the present petition to seek a direction that he be released on parole. The petitioner stands convicted under Section 302/392/394/397/411/34 IPC in case FIR No.119/2004. He was awarded death sentence by the trial court. However, in appeal, this court has reduced the sentence to Rigorous imprisonment for 25 years on 23.07.2014. The admitted position is that the petitioner lastly availed of parole between 17.08.2016 and 15.09.2016.

The submission of learned counsel for the petitioner is that the petitioner had earlier sought parole to be able to reconstruct his house. However, the same could not be completed. He submits that the petitioner's

parents are old and they would not be able to complete the construction. The photograph of the present state of affairs of construction has been placed on record.

I am not inclined to grant parole to the petitioner. Since the petitioner even according to his own statement was earlier on parole, merely because the petitioner's house is incomplete is no ground to again grant parole at such a short interval. In any event, even if he is granted parole for two weeks, the house would not be complete considering its present state. The petition is, accordingly, dismissed.
