By this petition the petitioner seeks anticipatory bail in case FIR No. 1074/2016 under Sections 323/380/457/427 IPC registered at PS Samaipur Badli, New Delhi on the complaint of Raj Singh pursuant to directions under Section 156 (3) Cr.P.C. In the complaint Raj Singh alleged that on 26th May, 2013 at around 10.00 AM when he had gone to his plot situated at Village Khera Kalan, Delhi he saw that petitioner was present there and had demolished the room and wall constructed by him at his plot and stolen all articles kept in the room. The details of the stolen articles were also given in the complaint. When the complainant made inquiry from the petitioner he was beaten with sticks.

The investigating is still under process. Documents have been shown by the parties claiming their respective possession of the land and till date no demarcation has been got conducted by the Investigating Officer to ascertain whether the possession of the land which the petitioner claims is unauthorised or not. The petitioner has already joined the investigation. 3.
Considering the nature of allegations and the fact that the petitioner has joined the investigation this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer and will not leave the country without prior permission of the Court concerned.
