The petitioner seeks Regular bail under Section 439 Cr.P.C. in case FIR No.172/16 registered under Sections 420/467/468/471/34 IPC at Police Station Sarita Vihar. Status report not filed. 2.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 9.4.2017.

Petitioner's counsel, on instructions, volunteered to pay `2,35,000/- to the complainant without prejudice and subject to future BAIL APPLN. 903/2017

adjustment (if any).

Considering the facts and circumstances of the case and petitioner's offer to pay `2,35,000/- to the complainant, the petitioner is admitted to bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the Trial Court. `2,35,000/- shall be paid by the petitioner to the complainant without prejudice and subject to future adjustment (if any) through Investigating Officer within two weeks by way Demand Draft.

In case of non-compliance, the State/complainant will be at liberty to approach this Court.
