% 10.02.2016 Learned counsel for the parties submit that the learned Arbitrator has already entered upon reference and the arbitration proceedings are in progress and the next date before the Tribunal is 24th February, 2016. They agreed that the present petition be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 by the learned Arbitrator. Ordered accordingly. The petitioner to file the copies of the pleadings before the Arbitrator within two weeks. He is also granted one final opportunity to file the rejoinder within two weeks before the learned Arbitrator. Learned counsel for the respondent has no objection if the interim order dated 19th May, 2015 to continue till the same is modified or vacated by the Arbitrator.
The petition is disposed of.
I.A. No.2008/2016 (u/o XXXIX R.1,2 & 4 CPC, by R-1) Issue notice.
Learned counsel for the petitioner accepts the notice. Let reply be filed within two weeks from today. This application will also be decided by the Arbitral Tribunal. CCP(O) Nos.80/2015 & 92/2015 and I.A. Nos.14943/2015 & 17332/2015 In view of the order passed in the main petition, learned counsel for the petitioner does not want to press these contempt petitions at this stage. The same are disposed of accordingly. Pending applications are also disposed of.
