% 14.02.2017 Both the parties are present in person along with their respective counsel. The undertaking/statement of the petitioner has been recorded in court.

The petitioner has undertaken today in court to vacate the property in question, namely, shop being No.M-10, Aruna Nagar, Magzine Road, Majnu Ka Tila, P.S. Civil Lines, Delhi -110054 and to hand over vacant physical possession to the respondent on or before 13.02.2019. The other terms and conditions have also been stated in the undertaking/statement of the petitioner recorded today. The undertaking/statement is taken on record and the petitioner shall remain bound by the same. The learned counsel for the petitioner submits that in view of the above undertaking, he does not want to press the present petition. The learned counsel for the respondent submits that in view of the

undertaking given by the petitioner, the respondent will not execute the eviction order till 13.02.2019.

Keeping in view the above, the present petition is disposed of. All the pending applications are also disposed of.

RC.REV. 485/2016 Dated: 14.02.2017 STATEMENT OF SH.JOGINDER PARUTHI, S/O SH.BARKAT RAM, R/O AT SHOP NO.M-10, ARUNA NAGAR, MAGZINE ROAD, MAJNU KA TILA, P.S. CIVIL LINES, DELHI -110 054, AGED ABOUT 60 YEARS, ON SA.

I undertake to this court to vacate the property in question, namely, shop in my occupation in property No.M-10, Aruna Nagar, Magzine Road, Majnu Ka Tila, P.S. Civil Lines, Delhi -110054 as described by the respondent in the eviction petition and hand over vacant physical possession of the same on or before 13.02.2019 to the respondent. I admit the bonafide need of the respondent.

I undertake that during the period the property is in my occupation, I shall continue to pay agreed rent @ Rs.900/- per month plus electricity and water charges for the property. I also undertake not to sub-let or part with possession of the property or cause any wilful damage to the property or induct any third party in the property.

I undertake to the court to abide by the order passed by the court today.
