Ms. Saroj Bidawat, learned Standing Counsel for MCD submits that MCD has no jurisdiction to carry out any demolition with respect to wall in question in the premises as it is neither an encroachment nor an unauthorised construction on public street and writ petition involves a private dispute between the Petitioner and the Intervenors.

Learned counsel for Petitioner seeks liberty to withdraw this writ petition to take recourse to appropriate civil remedies. 3.

Writ petition along with pending application is disposed of as withdrawn with liberty as prayed for in accordance with law, making it clear that this Court has not entered into the merits of the case.
