% 25.10.2016 Learned counsel for the petitioner submits that petitioner is about 21 years of age. FIR was got registered by the prosecutrix on 17th February, 2016. She was major at that time as her date of birth is "14th January, 1998". As per the allegations in the FIR and the statement under Section 164 Cr.P.C., prosecutrix has alleged that petitioner developed physical relations with her on the pretext of marrying her. However, subsequently, he refused to marry her.
Petitioner is in custody for the last eight months. Investigation is complete and charge-sheet has been filed. Petitioner is not required for investigation. Petitioner may be admitted to bail.
Learned APP has contended that prosecutrix has alleged that petitioner established physical relations with the prosecutrix on 9th September, 2015, when she was minor and against her will. Even thereafter, he had physical relations with her on 12th September, 2015. Subsequently, he refused to marry her.
Keeping in mind the totality of facts and circumstances, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
