O R D E R

% 28.09.2016 Crl. M.A. No. 15322/2016 Issue notice. Mr. Katyal accepts notice on behalf of the State. By this application, the petitioner seeks modification of the order dated 19.09.2016 insofar as the time granted for deposit of Rupees One Crore in this Court was two weeks from the date of the order, i.e. 19.09.2016.

The submission of learned counsel for the petitioner is that the petitioner is ready & willing to deposit the said amount. However, the petitioner needs some additional time to make the said deposit. He states that the petitioner is carrying an amount of Rs.20 Lakhs today in Court by way of a cheque drawn in favour of the Registrar General, Delhi High Court. He states that the said cheque shall be deposited today itself. Learned counsel further states that another instalment of Rs.25 Lakhs shall be

deposited by 05.10.2016. The remaining amount of Rs.55 Lakhs shall be deposited in two equal instalments on 01.11.2016 and 01.12.2016. Mr. Katyal submits that the petitioner be bound by the said condition so that in case the order is not complied with, the interim protection granted to the petitioner is withdrawn.

In view of the aforesaid, the application is allowed. Let the petitioner deposit the amount of Rs.20 Lakhs today in the Registry by way of cheque drawn in the name of the Registrar General of this Court. The second instalment of Rs.25 Lakhs shall be deposited by 05.10.2016. The third instalment of Rs.27.5 Lakhs shall be deposited on 01.11.2016 and the last instalment of the same amount shall be deposited on 01.12.2016. It is made clear that in case the amount is not so deposited, the interim protection granted to the petitioner vide order dated 19.09.2016 shall automatically stand withdrawn. In case the deposits are not made, the Registry shall forthwith place the matter before the Court.

The cheque No.313188 dated 27.09.2016 for Rs.20 Lakhs drawn on Yes Bank, Saket, has been delivered in Court to the Court Master. The Court Master shall ensure that the same is deposited with the Registrar General today itself.
