% 06.02.2018 I.A. No.563/2018 This application has been filed as the Arbitrator, appointed by this Court vide order dated 30.05.2017, had expressed his inability to proceed with the arbitration.

Learned counsel for the respondent submits on instruction and hands over a copy of the email dated 03.02.2018 which records that a substitute Arbitrator i.e. Mr.M.C.T. Pareva, Retd. ADG (CPWD) has been appointed. In view of the above, learned counsel for the petitioner submits that the application has become infructuous.
