% 23.03.2016 Learned counsel for the respondent submits that the petitioner has been promoted from the date on which his immediate junior was promoted in terms of the judgment dated 11th February, 2013. Learned counsel for the petitioner submits that the backwages have not been given to the petitioner to which learned counsel for the respondent submits that there is no direction by the Division Bench for payment of backwages.

At this stage, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to avail appropriate legal remedies available to the petitioner to claim the backwages. The petition is dismissed as withdrawn with liberty as prayed for. J.R. MIDHA, J.
