CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 29.08.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent no.2-Jyoti is present in Court and accepts notice. She has been identified by SI Surender Singh of police station Baba Haridas Nagar.

Respondent no. 2 (wife) says that she has settled the matter with petitioner no. 1 (husband) vide Settlement /Compromise Deed dated 27th August, 2018 of her own free will and without any undue force, pressure or coercion. She is living with petitioner no. 1 for the last two months and she has no grievance against petitioner no.1 as on today.

She further says that she has no objection in case FIR No. 744/2014 under Sections 498-A/406/34 IPC registered at Police Station Baba Haridas Nagar on the complaint of respondent no. 2 and the consequent proceedings emanating therefrom are quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3.

Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep them entangled in the criminal proceedings. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K.
