1. For the reasons stated therein, this application is allowed. The delay of 90 days in re-filing the petition is condoned.

2. Notice. Ms. Amrita Singh, learned counsel accepts notice on behalf of Respondent No. 1. She points out that an agreement was entered into between the Petitioner and only M/s. Creative Arts Education Society.

3. In that view of the matter, Respondent Nos. 2 and 3 are struck off from the array of the parties. The cause title of the petition will now read as: Design Dei Greatia Pvt. Ltd.

4. Learned counsel for the Respondent states that the Respondent has no objection to the Court appointing an Arbitrator for adjudication of the disputes between the parties.

5. It is ordered that the arbitration by a Sole Arbitrator shall take place under the aegis of the Delhi International Arbitration Centre ('DAC'). The Petitioner will appear before the DAC on 23rd February, 2017 at 11 am for further steps in this regard.

6. The petition is disposed of. A copy of this order be sent to the Additional Coordinator DAC forthwith S.MURALIDHAR, J JANUARY 30, 2017 Rm
