The petitioner has filed the present petition, inter alia, praying as under:- "Transfer the probate case bearing PC No. 7/2018 titled 'Krishan Kant Khattar v State &Ors.' From the court of Mr. Vishal Gogne, Ld. ADJ-02, Dwarka District Courts, to this Hon'ble Court for its adjudication alongwith CS(OS) No. 231/2016 titled Vijay Taluja Ors. v Krishan Kant Khattar" 2.

It is not disputed that the probate case bearing P.C. No. 7/2018 captioned 'Krishan Kant Khattar v State & Ors' is with regard to the probate of a Will, which is set up in defence by Sh. Krishan Kant Khattar in the suit filed for partition in this Court bearing case no. CS (OS) No. 231/2016 titled 'Vijay Taluja & Ors. v. Krishan Kant Khattar'. 3.

Since, it is admitted that some of the issues are common between the two cases, the present petition is allowed and the probate case PC No.

7/2018 captioned 'Krishan Kant Khattar v. State & Ors', is transferred from the Court of Learned ADJ, District Courts Dwarka to this Court. 4.

The registry is directed to list PC No. 7/2018 before the concerned roster bench of this court on 16.05.2019.

The petition is disposed of.
