O R D E R

% 27.04.2018 This petition has been filed seeking enforcement of the Arbitral Award dated 08.08.2013 as upheld by this Court vide its order dated 18.04.2017 passed in OMP 1203/2013.

The order dated 18.04.2017 has been challenged by the Judgment Debtor by way of Appeal being FAO(OS) No.247/2017 and certain interim directions with respect to the deposit of the awarded amount have been passed by the Division Bench of this Court.

Learned counsel for the Judgment Debtor submits that the said order has been complied with. This is disputed by the counsel for the Decree Holder. Be that as it may, as the appeal is pending before the Division Bench and certain interim orders have been passed therein, the learned counsel for the Decree Holder prays for leave to withdraw the present petition with liberty to file afresh subject to the orders passed by the Division Bench. In view of the above, the present petition is dismissed as withdrawn with liberty as prayed for.
