O R D E R
% 29.08.2018 Learned counsel for petitioners submits that petitioner no.1 is the sister and petitioner no.2 is the father of co-accused Sitesh Kumar Lal, against whom allegations of rape have been levelled. FIR was lodged after two years of the alleged rape.
Learned APP submits that co-accused is in judicial custody since 13th July, 2018. Learned counsel for petitioners submits that petitioners are ready to cooperate in investigation and appear before the Investigating Officer as and when called upon to do so. Learned APP has opposed grant of anticipatory bail to petitioners on the ground that the petitioners had assured the prosecutrix that they would get her married to co-accused Sitesh Kumar Lal.
Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioners be released on bail subject to each furnishing a personal bond in the sum of ₹10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. However, petitioners shall cooperate in the investigation and shall appear before the Investigating Officer as and when they are called upon to do so.
Bail application is disposed of in the above terms.
