% 19.09.2016 Petitioner is aggrieved by the order of rejection dated 26.07.2016 vide which is application seeking allotment of alternate plot has been rejected for the reason that there was a delay in filing for afore noted application.

Record shows that the land of the petitioner has been acquired pursuant to which he had received compensation of the afore noted acquired land on 10.03.2004. There was a limitation of one year prescribed for filing an application for allotment of alternate plot. This period has expired on 09.03.2005. Petitioner has filed the said application on 10.03.2005 which was after a delay of one day. His application was not considered.

On advance notice counsel for the respondent has put in appearance.

In view of the judgment Sima Devi Vs. Secretary & Others which has explained the delay of one day the case of the petitioner be considered on merits within an outer limit of four months from the receipt of this order.

Petition disposed of.
