% 31.05.2017 On 15th March, 2017, learned counsel for the defendants No.1 and 4 had stated that defendants were no more using the expression "HINDUSTAN".

The defendant no. 1 on his own behalf and as a partner of defendant no. 4 had also filed an undertaking to the effect that they shall not use the expression "HINDUSTAN" in any of their businesses. Today in Court, learned counsel for defendant nos. 1 and 4 has handed over undertaking by way of affidavit on behalf of defendant nos. 2 and 3 and M/. YPT Entertainment House Pvt. Ltd. which is taken on record. The undertakings given by the defendants and M/s. YPT Entertainment House Pvt. Ltd. are accepted by this Court and they are held bound by the same. The suit is decreed in terms of the undertakings

furnished by the defendants. The defendants are directed to pay Rs. 25,000/- to the plaintiffs as cost.

Since the present matter has been settled, Registry is directed to issue a certificate authorising the counsel for plaintiff to receive back from the Collector the half the amount of Court-fee paid by it in respect of the present suit.

With the aforesaid observations, present suit as well as pending applications stand disposed of.
