W.P. (Crl.) 1053/2015 Present FIR has been registered on the complaint of respondent no.2. A quarrel took place between petitioners and respondent no.2 on trivial matter wherein respondent no.2 has alleged that he was beaten by the petitioners by fist and kicks and later on by danda. Investigation is still going on and charge-sheet has yet not been filed. Respondent no.2 and petitioners have settled their disputes amicably. Respondent no.2 is present
in Court and submits that in view of the settlement arrived at between him and petitioners, he does not wish to pursue the FIR any further and the same may be quashed.
Since the petitioners and respondent no.2 have settled their disputes during the investigation stage itself, in my view, no fruitful purpose would be served in keeping them entangled in criminal case. Accordingly, in the interest of justice, FIR No. 168/2015 under Sections 308/452/506/34 IPC registered at police station Seemapuri and the consequent proceedings emanating therefrom are quashed, subject to cost of `5,000/- each to be deposited with the Delhi High Court Staff Welfare Fund within two weeks. Receipt, evidencing deposit of cost, be filed in the Registry and a copy whereof be given to the Investigating Officer. Writ petition is disposed of in the above terms. Dasti.
