O R D E R
% 27.10.2016 Learned counsel for the petitioner submits that the petitioner is aged about 20 years and has cleared his XIIth Class in the year 2016. The petitioner has no previous criminal record and is in custody for about three months.
It is submitted that the petitioner has already handed over the mobile phone to the Investigating Officer. The petitioner is not required for any further investigation and he may be released on bail. The investigations in the case are complete.
Learned APP has opposed the bail application. It is submitted that the
prosecutrix and the petitioner were friends. The prosecutrix is aged about 16 1⁄2 years old and is minor. The petitioner developed physical relations with the prosecutrix by blackmailing her, on the pretext that he had made her video and will make it public. He threatened continued to have physical relations with her on numerous occasions by blackmailing her. The mobile phone has been sent to Forensic Science Laboratory and its report is awaited.
Learned counsel for the complainant has appeared along with the mother of prosecutrix and submits that the petitioner is known to them and now it has been decided that their marriage will be solemnized after prosecutrix attains age of majority. It is submitted that the marriage will be performed after the prosecturix attains the age of majority. Keeping in mind the totality of circumstances, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only), with one surety of the like amount to the satisfaction of the trial court.
