Counsel for the respondent, who is present on advance notice, in fact, has raised objection as to the maintainability of the present appeal in view of the decision of a Division Bench in Shyam Telecom Ltd. Vs. A.R.M. Ltd., 2008 IX AD (DELHI) 646 and the Commercial Court, Commercial Division and Commercial Appellate Division of High Courts Act, 2015.

In view of the statement made, the appeal is dismissed as withdrawn.
