W.P.(C) 8372/2016 & CM No.34662/2016 (for stay) Mr.Ankur Chhibber, learned counsel for the respondents has placed before us letter dated 20.09.2016 which reads as under:- "2.

Pursuant to the order dated 14 Jul 2016 passed by the Hon'ble Supreme Court in Contempt Petition No.365/2016, promotions of officers empanelled against 141 additional vacancies, declassified vide impugned letter dated 24 Jun 2016 has been held in abeyance.

Meanwhile, three representations (two from 1997 batch officers including the Petitioner No.2 and one from 1998 batch officer) have been received and the same have been forwarded to Ministry of Defence, duly analysed. Awaiting decision of the Govt of India (Ministry of Defence) on distribution of vacancies and conduct of screening board

including directions on the representations received from three officers, no officer empanelled vide impugned letter is being promoted."

In view of this letter, Ms.Neela Gokhale, learned counsel for the petitioner seeks leave to withdraw the writ petition and the application. The petition and application are dismissed as withdrawn. INDIRA BANERJEE, J V. KAMESWAR RAO, J SEPTEMBER 20, 2016 gm
