O R D E R

% 06.07.2017 Mr. Digvijay Rai, learned counsel appearing for the respondent states that he has oral instructions to state that the respondent is agreeable for referring the petitioner to an independent Medical Board. Accordingly, as suggested by Mr. Rai for constitution of a Medical Board by the Medical Superintendent of Dr. Rajendra Prasad Eye Institute, New Delhi, this Court is of the view, that Medical Superintendent of the said Institute shall constitute a Medical Board for examination of the petitioner, as it is the case of the respondent that petitioner was denied appointment as Junior Assistant (Fire Service) on the ground that he is medically unfit (colour blindness). The date and time of the proceedings before the Medical Board shall be intimated to the petitioner as well as to the respondent so that the petitioner as well as the representative of the respondent, if necessary, shall be present before the Medical Board on the date and time fixed. The Medical Board

shall submit its report to the respondent with a copy to the petitioner within four weeks thereafter.

As agreed by the learned counsel for the parties their respective clients shall be bound by the outcome of the Medical Board. The petition is disposed of.

A copy of this order be sent to the Medical Superintendent, Dr. Rajendra Prasad Eye Institute, New Delhi within a week, along with a copy of the petition for reference.
