% 21.10.2016 Case of the prosecution is that petitioner along with co-accused Vijay hatched a conspiracy and robbed `3 crores from the complainant-Shaligram Jain. Co-accused Vikas, Parminder and Umed had intercepted the vehicle in which complainant was travelling with cash of `3 crores and robbed him. They also took him away in their car and threw him after about 1 km. Petitioner was ex-employee; whereas co-accused Vijay was employed with the complainant at the time of incident. The information was passed by the petitioner and co-accused that complainant was carrying huge sum of cash and at their instance, co-accused had looted the money. Learned counsel for the petitioner submits that petitioner is in custody for about four years. Trial may take time. TIP of the petitioner was not

conducted. Petitioner was not present at the spot. Accordingly, petitioner be released on bail.

Learned APP for the State submits that `54 lacs out of the looted amount has been recovered from the petitioner. Petitioner was in constant touch with other co-accused persons through his mobile numbers 9466429888, 8826803437 and 01276-321561.

Keeping in mind the gravity of offence, in my view, petitioner is not entitled to bail. Bail application is dismissed. A.K. PATHAK, J.
