% 04.09.2017 Petitioner institute was aggrieved by certain circulars (details of which find mention in the petition as also in the prayer clause) vide which the petitioner institute had been directed by respondent no.1 (DGT) to produce certain Building Complete Certificate (BBC related documents) qua the petitioner institute. He had been constrained to file the present writ petition. An interim order has been passed on 21.9.2016 wherein a direction had been given to the respondents to consider the case of the petitioner without, at that stage, insisting upon the Building Completion Certificate or the approved building plan provided that the petitioner satisfies other requirements as were communicated in the Brochure for the Academic Session 2016-17.

Today learned counsel for petitioner points out that earlier the petitioner institute fell outside the limit of Varanashi Municipality but now it is falling within the aforenoted limit. He has instructions to inform this Court that the BCC related documents qua the petitioner institute shall be submitted to the respondents. Additional submission being that in other connected petitions submission of BCC documents by such like institutes has been extended by this Court up to 15.12.2017; on parity same timeline be afforded to the petitioner as well. This position is not disputed. Accordingly, petitioner is granted time up to 15.12.2017 to procure his BCC related documents and submit them before the respondents; the respondents in the meanwhile will process the case of the petitioner institute.

This Court notes that in another connected matter of the same institute i.e. WP(C) No.6800/2017 BERS Private ITI Vs. Directorate General of Training and Anr. arguments have also been heard by this Court in which orders have to be passed today at 4.00 p.m. There are four grounds of rejection raised by respondent no.2 qua the petitioner institute. In view of the orders passed by this Court grounds of rejection qua the BCC related documents (two grounds) stand satisfied.
