This petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking appointment of a sole arbitrator to adjudicate the disputes between the parties.

The case of the petitioner is that the petitioner had booked one residential plot bearing No. B-50, Era Green World, Sector-8, Palwal, Haryana and a residential Villa bearing No.F-05, Era Green World, Sector8, Palwal, Haryana, which were being developed by the respondent. Two Builder Buyer Agreements were executed on 09.07.2012 and 25.09.2012, respectively.

Disputes having arisen between the parties. The petitioner has filed the present petition in view of the arbitration clause contained in the said agreement.

The learned counsel for the respondent who has entered appearance very fairly submits that he has no objection in case the court appoint a sole arbitrator to adjudicate the disputes between the parties without prejudice to the rights and contentions of the respondent. 5.

Accordingly, I appoint Mr. Prashant Mehta, Advocate (Mobile No.9999590003) as the sole arbitrator to adjudicate the dispute between the parties. The arbitration shall take place under the aegis of Delhi International Arbitration Centre, New Delhi (in short 'The DIAC'). A copy of this order be sent to the DIAC and to the learned arbitrator. 6.

The petition stands disposed of as above.
